1.0 - Throughout the outlined Terms of Service and Privacy Policy, the term "we", "us" and "our" refers to Nonic Cloud (nonic.cloud) trading as Oxide Hosting (oxide.host, oxide.systems or any other website we own/operate). The use of the terms: “user”, “account holder”, "client", "customer" and "you” refer to yourself as a visitor or client. We offer this site and services to the user on condition upon your acceptance of all outlined conditions, terms and notices stated throughout our Terms of Service (which can be located here) and Privacy Policy. When visiting our site or purchasing a product/service from us you are in agreement with our Terms of Service and Privacy Policy, including any additional terms and conditions and policies referenced herein and/or available via hyperlink. Nonic Cloud trading as Oxide Hosting reserves the right to change and modify our Terms of Service and Privacy Policy at any time without client notification. It is up to the client to periodically check and familiarise themselves with any adjustments to our Terms of Service or Privacy Policy.

If you disagree with our Terms of Service, Privacy Policy or any additional terms and conditions which are available via hyperlink then you may not access this website or use any of our services. Information we Collect

2.0 - Account Registration. When registering for an account with us, we may request the following information about yourself: your name, email address, phone number, company name (if applicable), address and security question answer.

2.1 - Direct Communications. In the event you directly contact us, we may request information about yourself: your name, email address, phone number and the content of the message and/or any attachments included.

2.2 - Payment Information. When using a third-party payment processor/gateway to complete transactions with us we may collect the following information: your name, company name, email address, address and telephone number. We do not store any of the listed information or fiancial account details on our systems; however, we may have access to this kind of information through our third-party payment processor. This data will be stored by the third-party payment gateway and their respective privacy policies will apply which can be found below:

  • When such information is neccessary, the requested information and the reason for such request will be outlined clearly to the best of our abilities to you before submitting any data to us at the point in which this information is required or if upcoming.

    3.0 - Cookies and Other Tracking Methods/Technologies. When accessing our services we automatically gather certain data regarding yourself and how you accessed our services. In addition, when accessing our services we may automatically get certain device information. This information may include the following: your internet protocol (IP) address, internet service provider (ISP), operating system, referring/exit pages, date/time stamp, landing page, browser type and referring URL/address. To access such information, a ‘cookie’ might be created on your device/computer when you access our services. Cookies contain small quantities of data which allow us to recognise you. When using our services, we may collect information about your utilization of our services; including information such as: processor usage, memory usage, storage capacity (including in-use storage amount), system-level metrics and navigation of our services. We use this data to maintain and improve the performance and utilization of our services, develop new features for our customers, protect the safety and security of our services and customer’s data. We may also use this data to create reports on the performance of our business.

    4.0 - We use the information collected via the methods stated above in various ways, these include:

  • Operate, maintain and provide our services to our consumers,
  • Understand and analyze how our services are used and operated,
  • Improve, personalize and expand our services to suit our customer’s needs,
  • Develop new products, services, features and functionalities to improve the customer experience,
  • Communicate with you directly for many means such as: customer service, updates about our business and other information in relation to the service. In the event you have subscribed to our marketing emails (referred to as our ‘mail listing’), we may also contact you for marketing and promotional purposes on the condition that the subscription to our mail listing has been complete,

    Security

    6.0 - We are dedicated to ensuring that your personal information is protected, this is to prevent misuse of your personal information. As an organisation we have implemented a variety of user access levels and a wide range of security features to protect your information from unauthorized use and access. However, we are unable to ensure that your data/personal information is protected 100% of the time and is 100% secure but we aim to maintain high levels of security where possible to ensure your data/personal information is protected.

    Data Retention

    7.0 - The data collected via the methods as previously stated are retained only for the length in which we have an ongoing business relationship which requires us to retain such information to continue to provide our services to you.

    7.1 - When the ongoing business relationship has ceased and the need to process your data is no longer required, your personal information will either be deleted (this occurs within two months of all business relationships ceasing) or anonymized or if this is not yet possible due to your personal data still being stored within a backup, then we will securely store such to the best of our abilities until deletion is possible. In the event that your data is anonymized, processing of your data will halt once anonymized.

    8.0 - Those users who are a registered user with us, you may login to our services to access certain associated information, you may also email: [email protected] to request such information. To ensure the safety and security of our customer’s/user’s data, we may take reasonable steps to verify your identity before providing, updating or removing your information. Your information provided to us may be stored within a backup periodically taken for disaster recovery purposes. Your ability to access and amend such data stored may be temporarily limited due to any of the following reasons:

  • Inhibit our responsibility to comply with legal obligations,
  • Inhibit our ability to complete investigations,
  • Breaching our outlined Terms of Service or Privacy Policy,
  • To create and/or defend legal claims.
  • Sharing Information

    9.0 - We share the information collected via the methods stated above in various ways, these include:

  • Legal Obligations - We may share customer information to ensure compliance with any applicable regulations in place or to meet any governmental request. We may also share information to enforce our Terms of Service (found here) and Privacy Policy. We also may share information with governmental organisations to prevent and identify fraud, technical or security issues.
  • Fraud Prevention - Upon ordering, clientele information (full name, company name, email address, address, telephone number, IP address information, browser information) will be shared with a third-party (MaxMind) for fraud prevention purposes and order analysis utilising their evaluation algorithms.
  • Business Transfers - Clientele information and user's information will be transferred to any business successor(s), acquirer(s) or any personal involved within the merger, acquisition or similar transaction of our business to ensure services can be migrated as easy as possible.
  • Payment Gateways - Clientele information may also be shared with payment gateways to process payments via the respective gateways or in the event of a chargeback/dispute regarding a transaction.
  • Registering via a Referral Link - In the event you register via a referral link, clientele information may be shared with the referrer to inform them that they referred you.
  • Billing Contacts - The primary account holder's information will be shared with those who are registered as contacts via our billing system.
  • With your Consent - We may also share clientele information with your consent.
  • Your Rights

    10.0 - Those users who are a resident of a European Union Member State and those states within the European Economic Area have the following rights as outlined by the General Data Protection Regulation (GDPR):

  • You may ask us to restrict the processing of your personal information, you may object to the processing of your data or you may request portability of your personal information; this can be completed by emailing [email protected].
  • If you wish to correct, access, update or request the deletion of your personal information, you may do so at any time either by logging into your client account (do note your account may only be closed via a ticket sent to the Data Protection department) or by contacting us via email at: [email protected].
  • If you wish to withdraw your consent to halt the processing of your personal information, you may contact us via the Data Protection department available via our Billing Area or contacting us via email: [email protected].
  • You have the right to opt-out of marketing emails, this can be completed at anytime via logging into our services (Billing Panel) and amending such detail. You may also opt-out of marketing emails via the 'opt-out' link provided within every marketing email.
  • Children/Minors

    11.0 - We do not knowingly collect data from those under the age of 16, children under the given age of 16 are prohibited from accessing and using our services, if you do not comply to such category please consult your parent/guardian to arrange alternative arrangements. If you identify/become aware of someone who is under the age of 16 and has provided us with personal information please inform us as soon as possible via: [email protected] and we will take steps to remove the necessary information from our servers.

    Legal Basis for Processing

    12.0 - The legal basis for us collecting and using personal data has been described above. However, we will collect information from you for the following reasons:

  • To identify and detect any illegal activities and any violations of our Terms of Service (found here) and this Privacy Policy,
  • To contact yourself regarding our services you have active with us as well as responding to any questions/enquiries you might have for us to answer,
  • To offer such services when a business interest is present and personal information is required to complete multiple actions (provide our services to the customer, improving our services and platforms we maintain as well as responding to requests).
